Welcome to Agromarket! These Terms of Service (“Terms”) govern your access to and use of our platform, including our website (Agromarket.com.gh), mobile application, and associated services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Agromarket, you agree to comply with these Terms and our Privacy Policy. If you do not agree, you must stop using the Services immediately.
2. Eligibility
To use the Services, you must:
- Process orders, facilitate payments, deliver products, and improve platform functionality.
- Provide accurate and up-to-date information during registration.
- Comply with applicable laws and regulations.
3. Account Registration and Responsibilities
- Account Creation: You must create an account to access certain features. Ensure all information provided is accurate.
- Security: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access.
- Account Use: You are responsible for all activities under your account. Agromarket reserves the right to suspend or terminate accounts for violations of these Terms.
4. Use of Services
- Permitted Use: You must create an account to access certain features. Ensure all information provided is accurate.
- Prohibited Activities: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access.
- Violate any applicable laws or regulations.
- Interfere with the proper functioning of the platform.
- Use the platform to engage in fraudulent activities.
- Reverse-engineer or tamper with the platform's systems.
5. Vendors and Product Listings
Agromarket allows registered vendors to list and sell their products on the platform.
- Vendor Responsibility: AgroMarket works with vendors to ensure they comply with product quality, packaging, and timely delivery of items to Agromarket's aggregation center.
- Product Availability: Product availability is subject to vendor stock levels. Agromarket is not liable for product unavailability due to vendor issues.
- Vendor-Specific Policies: Refunds, returns, and product-specific policies (like warranties) are governed by each vendor's individual policies, which may vary.
6. Order Placement and Processing
Agromarket allows registered vendors to list and sell their products on the platform.
- Order Process: When you place an order, it is distributed to the respective vendors supplying the products. Vendors send the items to Agromarket's aggregation center, where your order is processed and prepared for final delivery.
- Order Confirmation: An order is only confirmed after payment is received or after the affiliated organization approves it (if applicable).
- Order Approval for Affiliated Organizations: If you place an order through an affiliated organization (like a cooperative or agribusiness), the order will only be processed after the organization has approved it. Agromarket will notify you of the status of the approval.
7. Purchases and Payments
- Orders: Orders are subject to availability. We reserve the right to cancel or reject orders at our discretion.
- Payment Options:
- Direct Payment: Customers can pay directly at checkout using available payment methods
- Payment Through Affiliated Organizations: Customers can request payment through affiliated organizations (e.g., cooperatives or agribusinesses). The organization must approve the order before processing begins.
- Pricing: Prices are displayed in Ghanaian Cedis (GHS) and include applicable taxes unless stated otherwise.
- Order Cancellation: Orders can only be canceled before they are processed by vendors. Once vendors begin processing the order, cancellations may not be possible.
8. Delivery and Shipping
- Aggregation and Delivery: Products from multiple vendors are sent to Agromarket's aggregation center. Once consolidated, Agromarket arranges delivery to the customer's provided address.
- Delivery Timelines: Estimated delivery times are provided at checkout but may vary due to unforeseen circumstances. Agromarket is not liable for delays caused by vendors or logistical issues.
- Ownership and Risk: Ownership of products passes to you upon delivery.
9. Returns, Refunds, and Complaints
- Vendor Policies: Each vendor has their own return and refund policy, which governs returns and refunds for their specific products.
- Reporting Issues with Fresh Products (Groceries, Proteins, Fresh Produce):
- If you receive damaged, spoiled, or substandard fresh products, you must notify Agromarket within 6 hours of delivery.
- Complaints submitted after this period may not be eligible for refunds or replacements.
- How to Request a Return or Refund:
- Contact Agromarket at +233 53 236 7799 within 6 hours (for fresh products) or as per the vendor's return policy.
- Agromarket will coordinate with the vendor to resolve the issue.
- Refund Method: Refunds, if approved, will be made using the same payment method used during purchase. Refund timelines depend on the vendor's processing time.
10. Customer Responsibilities
- Accurate Information: Ensure that all delivery information (name, phone number, address) is accurate to avoid delays or failed deliveries.
- Timely Inspection: Inspect fresh products (groceries, proteins, fresh produce) upon delivery and report any issues within 6 hours.
- Compliance: Comply with all applicable laws and these Terms when using the Services.
11. Intellectual Property
All content, trademarks, and intellectual property on Agromarket are the exclusive property of Sesi Technologies or our licensors. Unauthorized use of any content is strictly prohibited.
12. Privacy
Our use of your data is governed by our Privacy Policy. By using Agromarket, you consent to the collection, storage, and processing of your data as described therein.
13. Limitation of Liability
- No Warranty: Agromarket is provided “as is” without any warranties of any kind. We do not guarantee uninterrupted service, accuracy, or completeness of information.
- Liability:
- We are not liable for delivery delays that arise from delayed approval of orders by affiliated organizations.
- We are not responsible for damages, spoilage, or delays that result from customer failure to inspect fresh products within 6 hours of delivery.
- Force Majeure: Agromarket is not responsible for delays or failures caused by events beyond our control, such as natural disasters, strikes, or supply chain disruptions.
14. Termination
We may suspend or terminate your access to Agromarket for violations of these Terms or for other reasons at our discretion.
15. Changes to the Terms
We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of Ghana. Any disputes will be resolved in Ghanaian courts.
17. Vendor-Specific Terms
Vendors are subject to additional terms and conditions that govern their participation on the Agromarket platform. Vendors are responsible for complying with all laws and regulations that govern the sale of their products.
